Terms and conditions
The terms and conditions regulate the relationship between Fykan and the customer.
By attending or booking/ordering a trip/event with or through us, you acknowledge to have read and agreed to the following terms and conditions:
1. BOOKING AND ORDERING
Booking and ordering can be made through our website, by email, by phone or via a third part.
The person who makes the booking accepts these conditions on behalf of all the people in the group and is responsible for all payments due.
For booking of our daytrips, the full amount will be charged upon booking.
3. CANCELLATION BY CUSTOMER
We must receive your cancellation notice in writing by e-mail to email@example.com Your cancellation date/time will be the date/time on which you send the e-mail.
Cancellation by customer - Day Trips
- Cancellation 7 days or longer prior to departure: full refund.
- Cancellation 3 days to 7 days prior to departure: will be charged 50%
- Cancellation less than 48 hours prior to departure: will be charged 100%
4. NOT SHOWING UP
No refunds are issued in the event that you fail to participate in the trip you have booked. `No-show` will be charged 100%. No-snow also includes meeting up after departure time.
5. CHANGES TO THE
Fykan shall, if possible, complete the event according to the program. It is reserved that the program may have to be changed due to significant changes in timetables, changed opening hours for accommodations or special conditions that make it difficult to carry out the trip as planned. If possible, we notify any significant changes before departure. Such changes give the participant the right to withdraw from the trip, the entire amount paid will then be refunded.
6. CANCELLATION BY FYKAN
We reserve the right to cancel any trip due to circumstances we can't control. Should cancellation occur, we will notify you as soon as possible. Cancellation may occur under circumstances like:
1. Limited attendees:
Many of our tours require a minimum number of participants. We reserve the right to cancel the trip, if the minimum number of participants isn't met. You will get the option between rebooking to another date or full refund.
2. Weather and other conditions:
We reserve the right to cancel or change any trip with the customers safety in mind. In case of changes or cancelation, you will get the option between rebooking to another day or full refund.
3. Illness or injury for the guide/tour leader
Medical incidents or limitations to the tour leader may require a leader to be replaced. In the event of such an incident a leader will be sought who has the same skill set and knowledge. The tour or event might be cancelled if we fail at replacing the guide. In such scenario occur, your total cost will be refunded.
Cancellation or changes by Fykan is not limited to point 1. to 3.
7. CANCELLATION AFTER THE TRIP HAVE STARTED
Fykan reserve the right to cancel the trip underway if:
1. The guide consider the participant not to be in the required physical or mentally shape to continue the trip in a safe way.
2. Weather or other condition makes it unsafe to continue.
Cancellation after point 1. and 2. does not qualify for a refund.
8. CUSTOMERS OBLIGATIONS
Participants are obliged to read the program thoroughly and consider whether they are physically / mentally able to attend the event, without any strain on themselves or others.
Each participant must inform the guide of medical conditions illnesses or disorders that may be relevant for safety reasons during the trip.
Each participant are obligated to follow the instructions given by the guide during the trip.
9. ACCEPT OF RISK
Outdoor activities, like the trips we offer, carry inherent risks.
We have strict a strict safety management system and try at all time to reduce risk, however we cannot eliminate all risks from our trips.
By participating in our trips you accept a certain degree of personal risk, resulting from the nature of the activity/trip you are attending.
Fykan does not take any responsibility for harm or injury on participants or their equipment unless the accident is due to seruios negligence by us or the guide.
Personal travel- and cancellation insurance is not included in the price for our trips and events.
It is recommended to ensure you have a personal travelinsurance that covers all the activities you participate in.
We carry Public Liability Insurance (coverage of NOK 10.000.000 per incident) that covers us for unforeseen incidents/injuries that might happen on our trips/events.
If you have a complaint with the service provided, complaints must be made immediately to us true or to the guide. Complaints must be made within 15 days of returning home, unless there are special reasons for extending the time.
Any dispute shall be settled in accordance with Norwegian law. Exclusive jurisdiction of Salten District Court in Norway.
